ALLGEMEINE GESCHÄFTSBEDINGUNGEN

Allgemeines

Das Festival Bottoms Up! wird von Katrin Kügler und Jesús Serrano (Swing Times) und Frauke Dornberg im Team (nachstehend auch „das Festival“, „die Veranstalter:innen“ oder „wir“ genannt) organisiert.

Die Zustimmung zu diesen Allgemeinen Geschäftsbedingungen ist Voraussetzung für die Teilnahme am Festival. Es dürfen nur volljährige Personen am Festival teilnehmen.

Wir behalten uns das Recht vor, Personen (Teilnehmende, Künstler:innen, Volunteers usw.), die sich nicht an die in unserem Code of Conduct beschriebenen Regeln halten, die Teilnahme zu verweigern. In solchen Fällen erfolgt keine Erstattung des Festival-Beitrags.

Anmeldung

Die Anmeldung erfolgt über das auf der Website bereitgestellte Online-Formular. Dort gibst du deine Kontaktdaten ein, wählst einen Pass und erklärst dich mit diesen Allgemeinen Geschäftsbedingungen einverstanden. Anschließend erhältst du eine automatische Bestätigung darüber, dass deine Registrierung eingegangen ist (Vorab-Reservierung). Daraufhin prüfen wir, ob noch Plätze vorhanden sind.

  • Wenn Plätze vorhanden sind, erhältst du eine weitere E-Mail mit Zahlungsinformationen. Sobald deine Zahlung eingegangen ist, bestätigen wir dir per E-Mail deine Teilnahme.

  • Wenn keine Plätze mehr vorhanden sind, erhältst du eine Benachrichtigung über deinen Platz auf der Warteliste.

Zahlung

Die Zahlung des Festival-Beitrags erfolgt per Banküberweisung an das in der E-Mail angegebene Konto. Nach dem Eingang der Bestätigungs-E-Mail ist der gesamte Ticketpreis innerhalb von fünf Wochentagen zu zahlen. Beachte, dass wir drei verschiedene Preise haben: 

  • Den ermäßigten Solidaritätspreis kannst du gerne in Anspruch nehmen, wenn du z. B. studierst/eine Ausbildung machst/in Rente bist/vorübergehend keine Beschäftigung hast oder auch, wenn du eine Behinderung hast. (Die Vorlage eines entsprechenden Nachweises ist Voraussetzung für die Inanspruchnahme des ermäßigten Preises.) Dies sind lediglich Beispiele, die Auflistung erhebt keinen Anspruch auf Vollständigkeit: Wenn du der Meinung bist, dass dir der ermäßigte Preis aus anderen (hier nicht angegebenen) Gründen zusteht oder wenn du dir auch den Soli-Preis nicht leisten kannst, sprich uns einfach an. Wir finden bestimmt eine Lösung.

  • Den Supporter-Preis kannst du zahlen, wenn du dazu beitragen willst, anderen die Teilnahme am Festival zu ermöglichen, denen es aktuell nicht so leicht fällt, den vollen Preis zu zahlen. Die über den regulären Preis hinausgehende Summe fließt in einen Support Fund, mit dem wir die Teilnahme von Menschen ermöglichen, die sich sonst das Festival nicht leisten könnten.

  • Alle Preise verstehen sich inkl. 19% Umsatzsteuer.

Stornierungsbedingungen

Das Organisieren eines Festivals ist ein arbeitsintensives Unterfangen, das viele Monate vor dem Festival-Wochenende beginnt und viel Zeit in Anspruch nimmt. Außerdem müssen im Voraus zahlreiche Kosten gedeckt werden (Teacher-Honorar, Raummiete, Versicherungen usw.). Daher ist bei einem solchen Projekt Planungssicherheit von großer Bedeutung. Aus diesem Grund haben wir folgende Stornierungsbedingungen:

  • Eine Stornierung bis 30 Tage vor dem Festival ist kostenlos.

  • Bei einer Stornierung zwischen 29 und 14 Tage vor dem Festival wird 50 % des Beitrags erstattet.

  • Bei einer Stornierung ab 14 Tage vor dem Festival ist keine Erstattung möglich.

  • Als Beginn des Festivals gilt der 11. Oktober 2025 um 10.00 Uhr.

  • Im Falle einer Erstattung zahlt Bottoms Up! nur die Festival-Gebühr (ganz oder teilweise, je nach Fall) zurück. Alle zusätzlichen Kosten, die der teilnehmenden Person entstanden sind (z. B. Reise- und Unterkunftskosten), werden von Bottoms Up! nicht erstattet und sind allein von der teilnehmenden Person zu tragen.

Wenn du dir unsicher bist, ob du wirklich teilnehmen kannst, empfehlen wir dir, eine Ticketversicherung abzuschließen!

Der Festival-Platz kann jedoch jederzeit in Rücksprache mit dem Organisationsteam an eine andere geeignete Person übertragen werden.

Absage des Festivals durch die Veranstalter:innen

Im Falle einer Absage des Festivals aufgrund höherer Gewalt oder aus anderen Gründen, die nicht durch die Veranstalter:innen zu verantworten sind, werden den Teilnehmenden mindestens 50 % der Festival-Gebühr erstattet. Für die Berechnung der tatsächlichen Erstattung werden die den Veranstalter:innen entstandenen Kosten (einschließlich des Arbeitsaufwands) berücksichtigt.

Code of Conduct

Mit der Anmeldung zum Festival erklärst du dich einverstanden, alle in unserem Code of Conduct beschriebenen Verhaltensregeln zu beachten.

Bild-, Ton- und Videoaufnahmen

Mit deiner Teilnahme, deiner Arbeit oder deiner ehrenamtlichen Tätigkeit erteilst du Bottoms Up! die Erlaubnis, Fotos und/oder Videos von dir, die während der Veranstaltung durch die Veranstalter:innen oder durch eine von den Veranstalter:innen damit beauftragte Person aufgenommen wurden, in Publikationen zum Zwecke der Dokumentation oder Werbung des Festivals (Social Media, Radio, Fernsehen, Print usw.) zu verwenden. Wenn du möchtest, dass ein bestimmtes Bild oder Video von dir gelöscht wird, schreib bitte eine Mail an hello@bottomsupfestival.com. Der veröffentlichte Inhalt wird daraufhin entfernt.

GENERAL TERMS AND CONDITIONS

General Information

The Bottoms Up! festival is organised by Katrin Kügler and Jesús Serrano (Swing Times) and Frauke Dornberg as a team (hereinafter also referred to as ‘the festival’, ‘the organisers’, ‘we’ or ‘us’).

You must agree to these general terms and conditions to be able to participate in the festival. Only people who are of legal age are allowed to attend the festival.

We reserve the right to deny admission to anyone (participants, artists, volunteers, etc.) who fails to comply with the rules outlined in our Code of Conduct. In this case, the festival fee will not be refunded.

Registration

You can register by filling out the online form provided on our website. Enter your contact details, select a pass and agree to these terms and conditions. You will then receive an automatic acknowledgement that your registration has been received (preliminary reservation). We will then check whether there are still spots available.

  • If spots are available, you will receive another email with payment information. Once your payment has been received, we will confirm your participation by email.

  • If there are no more spots available, you will receive a notification informing you that you are on the waiting list.

Payment

You can pay the festival fee by bank transfer to the account specified in the email. After you get the confirmation email, you'll be required to pay the full ticket price within five weekdays. Keep in mind that there are three different prices:

  • You are welcome to claim the reduced solidarity price if, for instance, you are a student/a trainee/retired/temporarily unemployed or if you have a disability. (Proof of eligibility must be provided in order to qualify for the discounted price.) The above are merely examples and the list is not meant to be exclusive: If you believe that you are eligible for the discounted price for other reasons (not listed here) or if you are unable to afford the solidarity price, please contact us. We will definitely try to work something out.

  • You are welcome to pay the supporter price if you would like to help others who are currently unable to afford the full price to attend the festival. The amount exceeding the regular price will be donated to a support fund, which we will use to fund the attendance of people who would otherwise not be able to afford the festival.

  • All prices include 19% VAT.

Cancellation policy

Organising a festival is hard work involving much time and effort, starting many months before the festival actually takes place. In addition, there are many expenses to cover in advance (teachers' fees, venue rent, insurance, etc.). Therefore, we need to be able to plan ahead with a certain degree of reliability. Consequently, the following cancellation policy applies:

  • Cancellations up to 30 days before the festival are free of charge.

  • For cancellations between 29 and 14 days before the festival, 50% of the fee will be refunded.

  • Cancellations 14 days or less before the festival are non-refundable.

  • The festival shall be deemed to commence at 10 a.m. on 11 October 2025.

  • In the event of a refund, Bottoms Up! will only reimburse the festival fee (in full or in part, depending on the specific case). Any additional costs incurred by the participant (e.g. travel and accommodation costs) will not be reimbursed by Bottoms Up! and shall be borne entirely by the participant.

If you are in doubt as to whether you will be able to attend, we would recommend that you purchase ticket insurance!

The festival spot may be transferred to another suitable person at any time subject to approval by the organising team.

Cancellation of the festival by the organisers

In the event of cancellation of the festival due to force majeure or other reasons beyond the control of the organizers, participants will be reimbursed at least 50% of the festival fee. The actual reimbursement will be calculated taking into account the costs incurred by the organizers (including labour costs).

Code of Conduct

With your registration for the festival, you agree to comply with all rules outlined in our Code of Conduct.

Pictures, audio and video recordings

By participating, working or volunteering for the festival, you grant Bottoms Up! permission to use pictures and/or videos of you taken during the event by the organisers or by a person commissioned by the organisers in any publication for the purpose of documenting or advertising the festival (social media, radio, television, print, etc.). If you would like a specific image or video of you to be deleted, please send an email to hello@bottomsupfestival.com. The published content will then be removed.
